Terms and Conditions
DISCLAIMER: All products are subject to availability. Substitutions may be necessary. Due to market conditions, prices may change without prior notice. Packages may not be exactly as pictured.
MINIMUM ORDER: Canada Only: No Minimum. USA & International: Due to the need for Customs & FDA Paperwork, all products must be ordered in units of 6 or more, otherwise a $10.00 charge will apply.
PRICES: Every effort is made to ensure the accuracy of our prices, however, should a discrepancy occur, the correct price will be charged. In this case, you will be notified of the change and adjustments to your order. Please note that our prices and/or terms and conditions are subject to change without prior notice. Canadian Customers Only: If applicable, GST/HST will added to your order when billed.
SAMPLES: Samples can be requested at the current listed price together with all applicable taxes and shipping charges.
CHOCOLATE: Please note that during the warm months, (June - September) in an effort to avoid melting, all chocolate will be shipped with ice packs and a nominal charge will be added to your invoice. Please note that even though chocolate is ice-packed, we assume NO liability should it arrived melted, due to transit time or extreme heat.
CLAIMS/SHORTAGES: All merchandise is checked prior to shipping, therefore, any claims regarding damages are to be made against the courier company. Any damaged products must be kept for verification or unless otherwise stated. Any shortages must be reported to us within 48 hours of receipt of your order.
BACKORDERS: All backordered items are automatically cancelled and will NOT be shipped separately, therefore, these items should be re-ordered with a future order.
SUBSTITUTIONS: Should a product be temporarily sold out, we will make every attempt to advise you accordingly, at which time a substitute will be recommended.
RETURNS: Due to health concerns, NO returns on food products will be accepted. Also, there are NO returns on baskets or any Seasonal Items.
NOTE: Should you choose to refuse your order for any reason once it has already been shipped, you assume all costs and liabilities and no refund will be issued.
PAYMENT TERMS: Orders must be pre-paid by Visa, MasterCard or American Express prior to shipping, until such time as terms are granted, which are subject to credit approval.
Overdue accounts are subject to a 2% per month finance charge and result in suspended credit privileges. A 3% finance charge will be added to all accounts paid by credit card after the 30 day period.
A $25.00 charge will apply to all NSF cheques.
SHIPPING: All Canadian orders are F.O.B. Newmarket, ON and all USA orders are F.O.B. Buffalo, NY via FEDEX GROUND at discounted rates, which savings are passed along to our valued customers.
**In the event you wish to pick up your order from our Cash & Carry Warehouse, in order to save on the shipping cost, please make sure that you contact us via email or telephone and advise our shipping department, otherwise your order will be shipped.**
NOTE: Since shipping charges are based on destination and weight, shipping is calculated separately after orders are packed.
